This Privacy Notice describes the personal information that Giant Bicycle, Inc. (or “Giant”, “we” or “us”) may collect or that you may provide when you visit our website, purchase a product or service, sign up to receive communications from us, download and use one of our mobile applications, visit one of our stores, or otherwise interact with us. This Notice also describes how we use and disclose personal information about you and the rights that you can exercise in relation to your information.

It is important that you read this Privacy Notice together with any other notices we may provide on specific occasions when we are collecting or processing personal information about you so that you are fully aware of how and why we are using your information. This Notice supplements other notices and privacy policies and is not intended to override them. In some cases, we may provide different or additional policies or notices about our information practices.  If you reside in California, Colorado, Connecticut, Nevada, Oregon, Texas, Utah, or Virginia, our U.S. State Privacy Notice [AN2] supplements this Notice.

1. Information we collect about you

Personal information, or personal data, means any information about an individual from which that person can be identified. It does not include information where identifiers have been removed (anonymous data).

We may collect, use, store and transfer different kinds of personal information about you which we have grouped together as follows:

  • Identity Information includes first name, last name, title, date of birth and gender.
  • Contact Information includes billing address, delivery address, email address and telephone numbers.
  • Financial Information includes payment details (e.g., PayPal account information and card details used when paying for goods and services).
  • Transaction Information includes details about payments to and from you and other details of products and services you have purchased from us.
  • Technical Information includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this website.
  • Location Information includes geolocation data used to determine your current location. This is collected when you activate location-enabled services on our website.
  • Profile Information includes your username and password, purchases or orders made by you, products registered by you (frame number or serial number), preferences, feedback and survey responses.
  • Usage Information includes information about how you use our website applications, products and services.
  • Activity Information includes any personal information provided via online chat conversations, when receiving support, and in any product reviews made by you.
  • Marketing and Communications Information includes newsletter subscription record, your preferences in receiving marketing from us and our third parties and your communication preferences.
  • Applicant Information includes information contained in your application or resume, such as your skills, experience and qualifications, previous work experience, salary information, and any other recruitment specific information

Our website and our mobile applications are not intended for children under the age of 13 and we do not knowingly collect information relating to children under the age of 13. Giant does not sell products for purchase by children on this website. You may not make purchases from this website unless you are at least 18 years old.

If you fail to provide personal information – Where we need to collect personal information by law, or under the terms of a contract we have with you, and you fail to provide that information when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us, but we will notify you if this is the case at the time.

2. How is your personal information collected?

We use different methods to collect data from and about you including through:

Information you provide to us. You may give us your Identity, Profile, Contact, Activity, and Applicant Information by filling in forms, making a purchase, applying for a role, or by corresponding with us by mail, phone, email or otherwise. This includes personal information you provide when you:

  • purchase our products or services (whether online or in-store);
  • create an account on our website;
  • apply for employment with us;
  • register your products (bikes or gears) on our website for warranty claim;
  • send us messages through online chat on our website;
  • leave product reviews through PowerReviews on our website
  • subscribe to our service, newsletters or publications;
  • request marketing to be sent to you;
  • enter a competition, promotion or survey; or
  • give us feedback or contact us.

Information collected by your use of our services. For example, Location, Transaction and Usage Information will be collected when you use our websites and applications or make a purchase. Some of our location-enabled applications require your Location Data for certain features to work. If you wish to use the particular feature, you will be asked to consent to your data being used for this purpose. You can withdraw your consent at any time by disabling Location Data in the settings.

Information we collect automatically; cookies; do-not-track signals. As you interact with our website, we may automatically collect Technical Data about your equipment, browsing actions and patterns. We collect this personal information by using cookies, server logs and other similar technologies.

We use cookies and similar technologies to help us remember you and your preferences when you revisit our website or applications. We may also permit third party service providers to place cookies through our website to perform analytic or marketing functions.  We do not control the use of such third-party cookies or the resulting information and we are not responsible for any actions or policies of such third parties. You can remove cookies from your computer through the browser settings. Please note however that doing so may affect, limit or degrade your ability to use of some features.

We do not currently use technology that recognizes a “do-not-track” signal from your web browser.

Third parties or publicly available sources. We may receive personal information about you from various third parties and public sources as set out below:

  • Technical Data from analytics providers, such as Google
  • Location Data from displaying embedded maps providers, such as Google
  • Contact and Transaction Data from providers of technical, payment, and delivery services such as credit card companies, PayPal and Affirm.

3. How will we use your personal information?

We will use your personal information to provide you with products and services, consider your application for employment, to enhance your experience using our sites, applications, or in our stores, and for other business purposes.  Examples of how we may use your personal information, include:

  • To register you as a customer or create an account on one of our applications.
  • To deliver our services to you, for example, through our applications.
  • To process and deliver your order, including to (a) manage payments, fees and charges and (b) collect and recover money owed to us.
  • To manage our relationship with you which may include: (a) notifying you about changes to our terms or policies and (b) asking you to leave a review or take a survey.

  • To enable you to partake in a prize draw, competition or complete a survey.
  • To administer and protect our business, this website, and our mobile applications (including troubleshooting, data analysis, testing, system maintenance, support, reporting, and hosting of data).
  • To delivery relevant website content and advertisements to you and measure or understand the effectiveness of the advertising we provide to you.
  • To use data analytics to improve our website, applications, products/services, marketing, customer relationships, and experiences.
  • To make suggestions and recommendations to you about goods and services that may be of interest to you.

4. Disclosures of your personal information

We may share your personal data with third parties, such as:

  • Other companies in the Giant Group that are involved in the provision of products or services to you;
  • Service providers, vendors, and contractors who perform services on our behalf (e.g., who provide IT and system administration services, payment processing services, customer service, or marketing).
  • Professional advisers, such as lawyers, bankers, auditors and insurers (e.g., where they are providing us with advice or when we need to make a claim on any insurance policies).
  • Regulators and authorities who require reporting of processing activities in certain circumstances (e.g., tax authorities or authorities responsible for preventing fraud).
  • Law enforcement authorities that submit binding legal requests for information that includes your personal data.  We may also share personal information on receipt of non-binding requests where we consider that it is in our legitimate interests to do so.
  • Where your personal data is relevant to any litigation or alternative dispute resolution in which we are involved, we may share your personal information with the other parties to that dispute or the courts (e.g., in disclosure or discovery).
  • Third parties to whom we may choose to sell, transfer or merge parts of our business or our assets (or other third parties for example when connected with due diligence or planning exercises undertaken in relation to such a transaction). Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this privacy notice.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal information for their own purposes and only permit them to process your personal information for specified purposes and in accordance with our instructions.

5. Security and Retention

We have put in place appropriate security measures to prevent your personal information from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. In addition, we limit access to your personal information to those employees, agents, contractors and other third parties who have a business need to know. They will only process your personal information on our instructions and they are subject to a duty of confidentiality.

We have also put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

We have no control and disclaim any and all responsibility and liability in connection with information that is submitted to, or collected by, third parties.

7. Information Rights and Choices

Accessing or Correcting Your Information.  You can access, correct, or delete certain information as follows:

Promotional Emails.  You can choose not to receive emails from us by “unsubscribing” using the instructions in any email you receive from us.  This will not stop us from sending emails about your account or your transactions with us.

Cookies.  You can choose to delete or block cookies by setting your browser to either reject all cookies or to allow cookies only from selected sites. If you block cookies performance on our website, it may be impaired and certain features may not function at all.

Location Information.  If our website collects precise location information, you will be asked to consent to the collection of this information.  If you initially consent to the collection of such information, you can subsequently stop the collection of this information at a later time by modifying the preferences on your website.

California, Colorado, Connecticut, Oregon, Texas, Utah, and Virginia have enacted consumer privacy laws granting residents of these states certain rights with respect to their personal information.  This Privacy Notice addresses disclosure and related requirements applicable to these states.  If you are a resident of one of the above-mentioned states, this Notice and our general Privacy Notice apply to you.

Under certain state laws, these activities may constitute “sales,” “sharing,” or “targeted advertising.”

We do not sell or share information considered to be “sensitive personal information” for marketing or advertising purposes. We do not sell or share any personal information that we know to belong to consumers under age 18.

You have the right to opt-out of having your personal information shared, sold, or used for targeted advertising or profiling.  See Your Privacy Rights section below for details on exercising your opt-out rights.

3. Your Privacy Rights

Opting Out of Sales, Sharing, and Targeted Advertising. You have the right to opt-out of having your personal information shared, sold, or used for targeted advertising or profiling. To opt-out, please contact us on RiderSupport@GiantBicycle.com or contact customer service 1-800-US-GIANT.

Access, Correction, and Deletion. Subject to certain exceptions and limitations found in the relevant laws, you have access, correction, and deletion rights.

You have a right to request details about the information we have collected about you and how such information is used and disclosed.  You also have a right to obtain your personal information in a format that is portable.

Residents of California, Colorado, Connecticut, Oregon, Texas, and Virginia also have a right to ask us to correct inaccurate information, subject to the nature of the personal information collected and how it is used.

You further can request that we delete personal information that we have collected about you. We will honour your request to the extent required by applicable law and subject to certain legal exceptions, like if we need to retain information for legitimate business purposes.

Right to Opt-Out of Automated Decision-Making.  We may conduct automated personal data processing to evaluate, analyse, or make predictions about you (e.g., about your personal preferences, interests, or location).  Residents of Colorado, Connecticut, Oregon, Texas, and Virginia have the right to opt-out of this profiling activity.  To opt-out, please send emails to RiderSupport@GiantBicycle.com

Appeals.  There may be times when we deny your privacy requests.  Residents of Colorado, Connecticut, Oregon, Texas, and Virginia have a right to appeal these decisions.  You may appeal by sending emails to RiderSupport@GiantBicycle.com.  If you have concerns about your appeal, you may contact the attorney general of your state.

Non-Discrimination.  We will not discriminate against you for exercising your privacy rights.

Authorized Agents.  Residents of California, Colorado, Connecticut, Oregon, and Texas may designate an authorized agent to submit certain privacy right requests on your behalf. We may ask for proof of a designated agent’s authority and confirm that they are registered with the appropriate state authorities.  In some circumstances, we may contact you to verify your identity and confirm that the agent has your permission to submit a request.

4. Notice to Nevada Residents/Your Nevada Privacy Rights

As noted above, we will not sell your information. However, if you are a Nevada resident, you may submit a request to opt out of future sales by sending emails to RiderSupport@GiantBicycle.com. We will maintain your request in the event our practices change in the future. Should your email address change, please submit a new request.  We reserve the right to take reasonable steps to verify your identity and the authenticity of the request.
